In March 2002, the Phoenix District Office of the EEOC (with participation from the Albuquerque District Office) brought this suit against Key Four Corners, Inc. (d/b/a Key Energy Services, Inc., Four Corners Division) in the U.S. District Court for the District of New Mexico alleging violation of the Equal Pay Act of 1963 ("EPA") and Title VII of the Civil Rights Act of 1964. Specifically, the defendant paid the charging party, a female employee, lower wages than at least one male employee for performing substantially the same work. In addition, the defendant retaliated against the charging party after she complained about the discrimination. In April 2002, the charging party filed a motion to intervene. However, the motion was never resolved, and the parties settled in June 2002 through a consent decree.
The two-year decree, containing non-discrimination and non-retaliation clauses, required the defendant to: increase the charging party's annual salary, provide her with a neutral employment reference, review and revise its anti-discrimination policies, post a notice of the decree, provide Title VII and EPA training, report to the EEOC at specified intervals, and pay the charging party $125,000.
