In April 2000, the Charlotte District Office of the EEOC filed this lawsuit against Crowder Construction Company in the U.S. District Court for the Western District of North Carolina alleging discrimination on the basis of race, African-American, in violation of Title VII of the Civil Rights Act of 1964. Specifically, the complaint alleged that the defendant subjected the complainants, African-American employees, to racial slurs on the work site and one instance where a coworker allegedly approached one of the complainants with a noose. The complainants intervened in the lawsuit in June 2000 and January 2001. Following discovery and a failed motion for summary judgment by the defendant in April 2002, the case was tried by a jury in January 2003 with the jury returning a verdict in favor of the defendants. Judgment was entered for the defendant in February 2003. Thereafter, the EEOC and complainants filed motions to vacate the judgment and for a new trial, which were both denied in March 2003.
