The Dallas District Office of the EEOC brought this action in the U.S. District Court for the Northern District of Texas, against Hooters Arlington Venture I, better known as Hooters Restaurant. The complaint, filed in March 2001, alleged sex discrimination in violation of Title VII of the Civil Rights Act of 1964; specifically that Defendant subjected the charging parties to a sexually hostile work environment, constructive discharge and retaliation because of their sex, female. Defendant moved for summary judgment in October 2002 but the motion was denied in August 2003.
The parties entered into a consent decree in October 2003. The decree, valid for two years, required Defendant to pay the four charging parties a total of $55,000 (individual amounts were not specified in the decree), expunge their employment records and provide them with a neutral employment reference if they wished. Defendant was enjoined from discriminating or retaliating in violation of Title VII and required to provide Title VII training to its employees, and post and distribute a notice of non-discrimination at its facility.
