The San Antonio District Office of the EEOC brought this action in the U.S. District Court for the Southern District of Texas, against Allied Feed, Inc. The complaint, filed in September 2000, alleged national origin discrimination in violation of Title VII. Specifically, the complaint alleged that Defendant had subjected the charging party to a hostile work environment based on his national origin, which was Hispanic.

The parties settled and a settlement agreement was signed by the judge in November 2001. The agreement provided that Defendant would pay a total of $8,000 ($7,000 to the charging party and $1,000 to another individual); that Defendant would post a notice regarding its non-discriminatory practices; that Defendant would remove any indications of this action from the charging party's files; and that Defendant would refrain from discriminating or retaliating against any present or future employees.
