In December 1996, the Birmingham Office of the EEOC brought this suit in the U.S. District Court of the Northern District of Alabama. We do not have a copy of the complaint; therefore, the exact allegations involved are unknown. However, it appears from the Memorandum Opinion that the complaint alleged the defendant discriminated against the three charging parties, female employees, on the basis of sex in violation of Title VII of the Civil Rights Act of 1964. Specifically, the Opinion indicates the defendant allegedly subjected the three charging parties to a sexually hostile work environment consisting of unwelcome sexual comments, touching, and requests for sexual favors, resulting in the constructive discharge of two of the charging parties and alleged retaliatory actions resulting in the discharge of the third charging party. The defendant appeared in court in April 1997 moving to extend time to answer but they never appeared before the court again. In May 1997 the court entered a default judgment against the defendant. The Court's order found not enough evidence was presented to sustain the retaliation claim, but the other claims were sufficiently proven. The Order required the defendant to pay $133,701.53 to be divided between the three charging parties.
