In July 2001, the Phoenix Office of the EEOC filed this lawsuit against Coast Energy Management, Inc., and DGB Technologies, Inc. in the U.S. District Court for the District of Arizona. The complaint alleged violations of Title VII of the Civil Rights Act of 1964 for sex discrimination and retaliation. It was alleged that a class of female employees were subjected to both physical and verbal sexual harassment that altered the terms and conditions of their employment and created a hostile work environment. Additionally, one named complainant was allegedly terminated in retaliation for her complaining about her unlawful sexual harassment. Following several settlement conferences and a bench trial, the judge accepted a consent decree between the EEOC and Coast Energy Management, Inc. in September 2004. Defendant was required to pay $225,000. Movant/Guarantor for defendant-successor DGB Technologies, Inc. filed for bankruptcy November 2004. In February 2005 there was an order deciding that DGB Technologies had successor liability under the consent decree establishing liability of Coast Energy Management. Following the judgment, defendant DGB Technologies, Inc. filed and appeal to the Ninth Circuit in March 2005, Docket Number 05-1557, which was dismissed through a stipulated dismissal in May 2005.
