The Memphis District Office of the EEOC brought this action against Tri-State Plumbing, Heating & Air Conditioning Contractors, Inc., United Association Of Plumbers, Pipefitters and Sprinklefitters, Plumber's Local Union No. 17, and United Association of Journeymen and Apprentices of the Plumbing and Pipe Fitting Industry of the United States and Canada, AFL-CIO in September 2005 in the U.S District Court for the Western District of Tennessee. The intervenor's complaint alleged racial and sex discrimination in violation of Title VII of the Civil Rights Act of 1964, and violations of 42 U.S.C. ß 1981. Eight complainants intervened in the EEOC's suit in January 2006. The defendants filed several motions to dismiss for failure to state a claim, all of which were denied. The case was ongoing in the district court as of April 22, 2008. In November 2007 a jury trial was scheduled for November 2008.
