On November 18, 1998, the Equal Employment Opportunity Commission ("EEOC") commenced this action on behalf of a former employee against the defendant, the Clay County Board of Education, in the U.S. District Court for the Northern District of Alabama. The plaintiff alleged violations of the Age Discrimination in Employment Act (ADEA), 29 U.S.C. §§ 621 et seq. The defendant answered the complaint on March 29, 1999.
Judge Robert B. Propst ordered a discovery cutoff of August 2, 1999, and scheduled a pretrial conference for December 15, 1999, after approving the parties’ motions. On October 22, 1999, the defendant filed a motion to extend time for filing dispositive motions and Judge Propst granted this motion on October 26.
On February 29, 2000, Judge Propst adjudicated that the case is dismissed without prejudice after being informed that the case has been settled. He further ruled that any party has the right to reopen the action within 30 days, upon good cause shown, or to submit a stipulated form of final judgment. We were unable to access the settlement.
There has been no docket activity since then and this case is now closed.
