The Memphis office of the EEOC brought this action in the U.S. District Court for the Western District of Tennessee, against Thyssenkrupp Elevator Manufacturing, Inc. The complaint, filed in March 2004, alleged race discrimination in violation of Title VII of the Civil Rights Act of 1964; specifically that Defendant failed to promote the charging parties and then discharged them because of their race, African American.
The parties entered into a consent decree in June 2004. The decree was valid for two years and required Defendant to pay a total of $25,000 to the two charging parties ($15,000 to one and $10,000 to the other), and expunge their employment records. Defendant was enjoined from discriminating or retaliating in violation of Title VII and required to post a notice of non-discrimination and provide EEO training to its employees.
