In September 1998, the Seattle District Office of the EEOC brought this suit against Future Shop, Inc. in the U.S. District Court for the Western District of Washington. We do not have a copy of the complaint; thus, the exact allegations involved are unknown. According to a stipulation for amendment to the consent decree, the complaint alleged that the defendant failed to consider the charging party and other similarly situated individuals for employment because of their age in violation of the Age Discrimination in Employment Act of 1967. After a couple scheduling orders, the parties settled through a consent decree in April 1999. We do not have a copy of the decree; therefore, the exact terms of the settlement are unknown.
The decree was amended once in August 1999 and again in May 2000; however, it appears that these amendments did not affect the substantive terms of the decree. According to one of the stipulations for amendment to the decree, the decree required the defendant to pay $361,000 to establish a settlement fund to be distributed among the victims of the discrimination.
