The Detroit District Office of the EEOC brought this action in the U.S. District Court for the Western District of Michigan, Southern Division, against BW-Warrenville Operations, Inc., d/b/a Buffalo Wild Wings Bar & Grill. The complaint, filed in September 2005, alleged race discrimination in violation of Title VII of the Civil Rights Act of 1964. Specifically, the complaint alleged that Defendant had racially harassed the charging party and subjected him to a racially hostile work environment by hanging a noose in the charging party's office and posting a picture of a confederate flag.
In February 2006, the parties proposed a consent decree which was signed in March 2006. The decree, which was valid for one year, contained non-discrimination and non-retaliation provisions and required Defendant to pay the charging party $30,000, provide mandatory Title VII training to its management and human resource personnel and post a non-discrimination notice in a conspicuous location.
The decree was entered in 2006 and scheduled to last 2007. No further docket entries exist, so the case is closed.
