The EEOC's Milwaukee and Minneapolis offices filed this suit on August 11, 1999 in the U.S. District Court for the District of Minnesota. The suit alleged that defendant Long Prairie Packing violated Title VII and the ADA through a pattern or practice of sexual and disability-based harassment of men. According to the EEOC, this was the first class action suit alleging a pattern of male-on-male sexual harassment.
On the date the complaint was filed, the parties also filed a joint motion for entry of consent decree. The court entered the consent decree on August 13, 1999. The case remained open after entry of the consent decree so the court could oversee the EEOC's distribution of the settlement to the class-members.
The defendant agreed to create a settlement fund containing $1,900,000 to be distributed to class-members through the EEOC. The defendant also agree to provide training, institute a new complaint procedure and develop a new discrimination during the 3-year consent decree.
