In May 2001, the San Antonio District Office of the EEOC filed this lawsuit against Excel Corporation in the U.S. District Court for the Western District of Texas alleging retaliation in violation of Title VII of the Civil Rights Act of 1964. We do not have a copy of the complaint; therefore, the exact allegations involved are unknown. The charging parties intervened in the lawsuit in February 2002. Following a transfer of venue to the U.S. District Court for the Northern District of Texas, some discovery and mediation, the parties settled the lawsuit in June 2002 through a consent decree.
The one year decree, containing an anti-retaliation clause, required the defendant to: distribute a notice regarding employee rights to all managers for signature and pay $20,000 to be distributed among two complainants.
