The Memphis Office of the EEOC filed this action in the District Court for the Eastern District of Arkansas. The Defendant was Virco Manufacturing Company, a manufacturer and supplier of furniture and equipment for K-12 schools. The controversy involved the alleged harassment of an employee based on his national origin (Mexican) in violation of Title VII of the Civil Rights Act of 1964. The lawsuit was filed in September 1997 and was eventually resolved by voluntary settlement - first in June of 1998 with the complainant, and then in July 1998 with the EEOC. The complainant intervened in the case, but his relief is unknown as only the EEOC's settlement was available. According to the EEOC's consent decree, the company had to provide a training seminar, post a notice, and report to the EEOC. The decree was to last for one year.
