In July 2004, the EEOC's Miami office filed this suit in the U.S. District Court for the Middle District of Florida alleging that Acculab Laboratories, Inc. had violated Title VII by exposing an employee to sexual harassment and then terminating her in retaliation of her complaints about sexual harassment. The complainant intervened in the EEOC's suit and added a claim under the Family Medical Leave Act alleging that the defendant had unlawfully denied her medical leave based on her serious health condition multiple sclerosis. After a failed attempt at mediation in February 2006, the parties were preparing for trial until, after extensive negotiations, they agreed on a consent decree which was adopted by the court in June 2006. The decree ordered defendant to pay the complainant a total of $25,000 and enjoined the defendant from discriminating and retaliation and required the defendant to post a notice of equal employment opportunity rights, create an anti-discrimination policy, and create equal employment opportunity training programs.
The terms of the agreement were to run for 3 years. The docket sheet does not show any further enforcement took place; the case was presumably closed in 2009
