Contraception Insurance Mandate

Over a hundred Catholic organizations and other religious groups--including both not-for-profit organizations and corporations with a few owners--have filed federal lawsuits challenging the Affordable Care Act’s requirement that birth control be part of health insurance for employees. This collection brings together these lawsuits. In the first major birth control challenge, Burwell v. Hobby Lobby, the Court, in an opinion by Justice Alito, decided that the Religious Freedom Restoration Act (RFRA) prevented the government from enforcing the birth control mandate against public companies, as long as the companies were owned by a small number of people who claimed sincere religious beliefs. The impact of that case is filtering through cases filed by similar companies. In Zubik v. Burwell, the Court will decide in spring 2016 whether the current regulatory fix, letting religious employers notify HHS instead of their health insurer about their objection to birth control coverage for their employees, still violates the RFRA.
