Case Summary

This case was brought in the early 1980s by two DuPage County Jail inmates against the County and various officials. Plaintiffs claimed they were strip searched in violation of their rights to be protected from unreasonable search and seizure and their rights to privacy.

The claim arose out of an arrest made on January 1, 1980. Plaintiffs were both subjected to strip searches pursuant to the county's blanket strip search policy.

On December 9, 1985, the Court (Judge Moran) denied Defendants' motion for Summary Judgment, and held that a blanket strip-search policy, regardless of offense was not constitutional as a matter of law; there were additional facts to be determined.
