Plaintiff, a 19-year-old male, filed this case on December 12, 1989 in the United States District Court for the Central District of Illinois against arresting officers, jailer, and county officials for civil rights violations arising out of his arrest for driving under the influence. Plaintiff claimed he was improperly subjected to a strip search at the scene of the arrest.
The District Court (Mag. Judge Kauffman) entered judgment in favor of Defendants and plaintiff appealed.
The United States Court of Appeals for the Seventh Circuit (Judge Foreman, District Judge sitting by designation) upheld the lower court in all respects except that he found that evidence created a fact issue as to whether the
arrestee was indeed subjected to an unlawful strip search at scene of arrest, an act which would be unreasonable without reasonable suspicion. The case was remanded.
