In 1968, a 39 year old non-immigrant industrial trainee from India filed a petition for Judicial Review of a decision rendered by the Regional Commissioner of the Immigration and Naturalization Services against the District Director of the U.S. INS in the U.S. District Court for the Central District of California. Petitioner instituted this action for review of the District Director's decision denying his petition for classification under section 203 of the Immigration and Nationality Act. Petitioner claimed that the District Director erred in finding that he did not qualify as a member of the professions as either a water-well specialist or science instructor.

On February 3, 1969, the District Court (Judge J. Hauk) issued a Decision, Findings of Fact, Conclusions of Law, and Order which granted Respondent's motion for summary judgment and affirmed the decision of the District Director. Agarwal v. District Direct of the U.S. INS 299 F.Supp 291, 296. (C.D. Cal. 1969)
