In September 1997, the Dallas District Office of the EEOC filed this lawsuit against in the U.S. District Court for the Northern District of Texas against Multicare Family Clinic, Texas Healthcare Network and Columbia HCA who were doing business as Multicare Family Clinic, and Fenyves & Nerenberg, M.D.P.A. alleging discrimination on the basis of gender, female, and retaliation in violation of Title VII of the Civil Rights Act of 1964. In September 1997, the Dallas District Office of the EEOC filed this lawsuit against in the U.S. District Court for the Northern District of Texas against Multicare Family Clinic, Texas Healthcare Network and Columbia HCA who were doing business as Multicare Family Clinic, and Fenyves & Nerenberg, M.D.P.A. alleging discrimination on the basis of gender, female, and retaliation in violation of Title VII of the Civil Rights Act of 1964. We do not have a copy of the complaint; therefore, the exact allegations involved are unknown. However, it appears from the March 1999 Memorandum Opinion and Order that the defendant allegedly subjected the parties to a sexually hostile work environment and terminated them based upon their opposition to these actions. Following discovery, the court granted summary judgment against two of the four complaining parties and dismissed all defendants but Fenyves & Nerenberg, M.D.P.A. in March 1999.

Following a jury trial regarding the claims of the remaining two complainant, the jury found in favor of the defendant for one complainant, and in favor of the plaintiff for the other complainant. Defendant Fenyves & Nerenberg, M.D.P.A. was ordered to pay $50,000 to one defendant, pay 75% of the EEOC's court costs, and was enjoined from discriminating against employees and operating any business without adopting an effective policy against sexual harassment, effective procedures for complaining about sexual harassment, and posting conspicuous notice of the policy. The EEOC was required to pay the full court costs of the other defendants.
