In September 2004, the EEOC district office in Detroit, Michigan brought this action against the Laborers' International Union of North America Local No. 465 in the U.S. District Court for the Eastern District of Michigan. The complaint alleged that the defendant violated the Americans with Disabilities Act of 1990 (ADA) when it refused to place employees on its "out-of-work" list without undergoing a medical examination and responding to medical inquiries.
The case was settled in May 2006. The parties agreed that the defendant would refrain from discriminating based on disability, would no longer subject employees to submit to medical inquiries or examinations prior to being placed on its "out-of-work" list, refer all able employees to available laborer positions, give an unspecified amount of money to the class of workers in question, post an ADA notice, and provide EEO training. The decree was to last for three years. The docket sheet doesn't show any further enforcement took place; the case was presumably closed in 2009.
