In August 2006 the Houston Office of the EEOC filed this lawsuit against hospital transportation assistance provider TH Healthcare, Ltd., doing business as Park Plaza Hospital and Tenet Employment, Inc. in the U.S. District Court for the Southern District of Texas, alleging discrimination on the basis of mental disability in violation of the Americans with Disabilities Act of 1990. Specifically, the complaint alleged the defendants refused to hire mentally disabled transportation assistants at their hospital and caused those already employed to be terminated. Following some discovery, the parties settled the lawsuit in October 2007 through a consent decree.
The two-year decree, containing an anti-retaliation provision, required the defendant to: make compliance reports, keep records, establish a compliance liaison, allow the EEOC access for monitoring, utilize objective hiring criteria, post notice of employee rights, provide employee training, and pay $122,500 to an unknown number of class members. The docket sheet does not show any further enforcement; the case was presumably closed in 2009.
