Following cross-motions for summary judgment, the District Court (Judge Robert Dixon Herman) granted plaintiff's motion for summary judgment in part and denied in part. The court held that the limitation of plaintiff's correspondence to a pre-established list of individuals was an unreasonable and arbitrary infringement of his First Amendment rights, but allowed defendants to prohibit plaintiff from mailing correspondence to a juror named as a defendant in plaintiff's civil action.
