The Phoenix District Office of the EEOC filed this case in the U.S. District Court for the District of Arizona. The defendant was American Home Furnishings, Inc. It was alleged that the complainant was passed over for a promotion on the basis of her race in violation of Title VII of the Civil Rights Act of 1964. The lawsuit was filed in September 2002 and went to trial, with the jury returning a verdict for the plaintiff in March 2005. Before the case went to trial, the defendant made a motion for summary judgment, which was denied. After the verdict was returned, the defendant appealed, but the judgment was affirmed. EEOC v American Home Furnishings, Inc., 220 F. App'x. 704 (9th Cir. 2007). The complainant, who did not intervene in the case, was awarded a total of $120,000, and was given a promise of positive job references along with expungement of any mention of the incident from her personnel file. In addition, the company had to provide five training sessions, update its employee manuals and promotion procedures, and make semi-annual reports to the EEOC.
