In February 2001, the EEOC district office in Birmingham, Alabama brought this suit against Bellsouth Telecommunications, Inc., a regional telephone and internet provider, in the U.S. District Court for the Southern District of Alabama. Fourteen individuals intervened in the case. The complaints state that it was alleged that the defendant violated Title VII of the Civil Rights Act of 1964 when it refused to promote, training, or even test Black employees for promotion because of their race. …

In February 2001, the EEOC district office in Birmingham, Alabama brought this suit against Bellsouth Telecommunications, Inc., a regional telephone and internet provider, in the U.S. District Court for the Southern District of Alabama. Fourteen individuals intervened in the case. The complaints state that it was alleged that the defendant violated Title VII of the Civil Rights Act of 1964 when it refused to promote, training, or even test Black employees for promotion because of their race. After consenting to a trial by a magistrate judge and almost a dozen discovery motions, the parties settled and a consent decree was entered in October 2003.

In the consent decree, the parties agreed that the the defendant would pay the fourteen intervenors $883,000, make no public statements about the decree, promote two of the complainants when positions become available, provide EEO training, post EEO notices, not use the BMAT test in its promotion efforts, inform non-management of the management program, refrain from retaliating, and submit semiannual compliance reports. No fees or costs were awarded. The terms of the decree ran for two years.
