In May 2001, the Philadelphia District Office of the EEOC filed this complaint against Exide Corporation in the U.S. District Court for the Eastern District of Pennsylvania. We do not have a copy of the complaint; therefore, the exact allegations involved are unknown. The charging party intervened in this lawsuit in October 2001. Following the defendant' declaration of bankruptcy and reformation as a new corporation in April-June 2002, and an administrative closure of the case in July 2002, the parties settled the lawsuit in September 2003 through a consent decree. We do not have a copy of the Decree; therefore, the exact terms of the agreement are unknown.
