In June 1997, the Philadelphia District Office of the EEOC filed this lawsuit in the U.S. District Court for the Eastern District of Pennsylvania alleging discrimination on the basis of race, African-American, sex and ethnicity. We do not have a copy of the complaint; therefore, the exact allegations involved are unknown. The complainant intervened in the lawsuit in August 1997. Following a motion to dismiss by the defendant which was granted in part, restricting the intervening plaintiff's complaint to the issues initially filed within the EEOC, discovery and denied motions for summary judgment filed by the defendant, the case was tried by a jury in May 1998 with the jury returning a verdict in favor of the defendant. The court entered judgment for the defendant at the end of May 1998. The intervening plaintiff appealed the case in June 1998, and the EEOC appealed the case in July 1998. The exact outcome of the appeals are unclear, but it appears that the intervening plaintiff's appeal was terminated and the EEOC's appeal was voluntarily dismissed.
