After reviewing the claims in Harrington and Count II alleged by the Bolden plaintiffs, I find that the issues in each case are separate and distinct causes of action. Harrington grew out of the inadequare treatment of persons with illness while incarcerated in jail. Count II of the Bolden complaint, on the other hand, deals with the exclusion of persons with disabilities from pretrial release programs and the failure to make proper arrangement upon discharging inmates. Since Bolden deals with claims that arise at a completely different stages of the inmates interaction with the department of corrections, I find that it should be filed as a separate case.
