EEOC's Houston, TX office filed this Title VII sexual harassment lawsuit against the defendant, Allied Vista Inc. d/b/a Vista Fibers in the United States District Court for the Southern District of Texas (Houston) on 09/28/2001. EEOC alleged that two former female employees at defendant's Houston facility were subject to sexual harassment and were discharged in retaliation for opposition. The individual complainants did not intervene in the lawsuit or file a separate lawsuit.
The parties settled in private and filed a joint motion to enter a consent decree. The district court entered a consent decree on 02/19/2003.
Under the three-year consent decree, the defendant agreed to pay one complainant $18,000 and the other $5,000. The defendant was required to provide neutral references for both individuals and keep the record of their involvement in the lawsuit confidential. Additionally, the defendant agreed to stop adopting different break rules for male and female employees and maintain its policies on sexual harassment. The defendant would also provide training to all managers at its Houston facility, post notice of nondiscrimination at the facility and name a company representative as liaison with the EEOC.
