The Seattle District Office of the EEOC brought this action in the U.S. District Court for the District of Idaho, against Ralph's Inc, d/b/a Sherman IGA. The complaint, filed in April 2001, alleged sex discrimination in violation of Title VII of the Civil Rights Act of 1964, specifically that Defendant subjected the charging parties to sexual harassment, constructive discharge and retaliation, because of their sex, female. In April 2002 Defendant filed a motion to dismiss the damage claims but the motion was denied in August 2002. In September 2002 the parties engaged in a settlement conference and in October 2002 a consent decree was entered.

The decree, valid for three years, required Defendant to pay the three charging parties a total of $96,500 ($46,000, $40,000, $10,500), provide them with neutral employment references and expunge their employment records. Defendant was enjoined from discrimination or retaliating in violation of Title VII, and required to provide annual employment discrimination training to its employees, post a notice of non-discrimination, hire a consultant to develop a written anti-discrimination policy and report regularly to the EEOC about its compliance with the decree.
