The EEOC Dallas office filed this suit in U.S. District Court for the Northern District of Texas, Dallas Division, on March 27, 2000. The suit alleged that defendant Dalfort Aerospace LP failed to reasonably accommodate a Seventh Day Adventist, in violation of Title VII of the Civil Rights Act, by refusing to hire him after he notified defendant that he could not work during his Sabbath. In its motion for summary judgment, the defendant claimed that it would have had to violate its collective bargaining agreement to accommodate the complainant. The EEOC also filed a motion for summary judgment. The court granted defendant's motion for summary judgment on February 19, 2002, denied the EEOC's motion, and entered final judgment in favor of the defendant.
