The Charlotte District Office of the EEOC brought this suit against Dollar General Corporation, doing business as Dollar General Stores, in September 2001 in the U.S. District Court for the Western District of North Carolina. The case was transferred to the Middle District of North Carolina. The complaint an alleged unlawful termination of an employee based on her mental disabilities in violation of the Americans with Disabilities Act (ADA). Each party filed a motion for summary judgment on the same day in November 2002. Both motions for summary judgment were denied in March and less than two months later, in May 2003 the case was settled. The settlement agreement included basically only monetary relief. The defendant was to give the complainant $45,000 which would be placed in a special needs trust for her. The other provisions for relief included the defendant discussing the ADA in the company newsletter as well as to continue the training they already have in place.
