In September 2002, the San Francisco District Office and San Jose Office of the EEOC filed this lawsuit against the integrated farming business Harris Farms Inc. in the U.S. District Court for the Eastern District of California alleging discrimination on the basis of gender, female, in violation of Title VII of the Civil Rights Act of 1964. We do not have a copy of the complaint; therefore, the exact allegations involved are unknown. Following discovery, the case was tried before a jury in November 2004 and concluded in January 2005 with a verdict in favor of the plaintiff. The complaining party was awarded $ 994,000 and the court awarded injunctive relief, which included a prohibition of retaliation, equal employment opportunity for employees, and posting a notice of employment rights. The defendants appealed the decision to the U.S. Court of Appeals for the Ninth Circuit in January 2005, and the complaining party appealed the decision shortly afterwards after being denied attorney fees. No outcome has been noted: therefore, the final disposition of this lawsuit is unknown.
