Case Summary

The Seattle office of the EEOC brought this suit against Crew Concepts, Inc. in the U.S. District Court for the District of Idaho. The complaint alleged that Crew Concepts, Inc. violated Title VII of the Civil Rights Act of 1964 by sexually harassing two women, failing to take prompt remedial actions to stop the harassment resulting in constructive discharge, and discriminated against these women in requiring them to pay higher health insurance premiums than their male counterparts. Mustang Helicopters, Inc. and Helicraft 2000, Inc. were included in an amended complaint; the EEOC subsequently dismissed its suit against these two parties. The EEOC and Crew Concepts seem to have attended voluntary ADR and subsequently settled the case in September 2007, by entry of a consent decree.

The decree included a non-discrimination clause. Contingent on Crew Concepts, Inc. increasing the size of its operation to 15 or more employees, it is required to adopt a written Title VII policy, communicate this policy to all employees, investigate all complaints of discrimination, harassment, and/or retaliation promptly, designate at least two upper management employees charged with investigating such issues, and supply the EEOC with written reports annually. In addition, Crew Concepts, Inc. agreed to pay $40,000 to the two former employees. The decree was to last for three years. The docket sheet doesn't show any further enforcement took place; the case was presumably closed in 2010.
