In February 1998, the Denver Office of the EEOC brought this lawsuit against Aksarben Nursing Centers Inc., doing business as Aksarben Manor, in the U.S. District Court for the District of Nebraska. We do not have a copy of the complaint; therefore, the exact allegations involved are unknown. However, it appears from the docket entry regarding the default judgment that the EEOC alleged the defendant committed racial discrimination in violation of Title VII of the Civil Rights Act of 1964. Following some discovery and a referral of the case to U.S. Bankruptcy Court in March 1999, default judgment was entered against the defendant in December 1999.
