In September 1998, the EEOC district office in Seattle, Washington brought this suit against the Amalgamated Sugar Company in the U.S. District Court for the District of Idaho. The complaint alleged that the defendant violated Title VII of the Civil Rights Act of 1964 by discriminating against Hispanic workers. Specifically, the EEOC alleged that although several individuals had worked for the defendant in previous years as seasonal workers, the defendant refused to hire them again because they were not proficient in spoken English.

There was extensive discovery during the litigation and a stipulation to dismiss the claims of one complainant. The defendant's motion for summary judgment was denied. After a consent to trial by magistrate, a nine-day jury trial ensued. The jury found in favor of the defendant on May 11, 2000. The defendant was awarded fees in the amount of $5479.85.
