The Denver District Office of the EEOC brought this action in the U.S. District Court for the District of Colorado, against The Denver Publishing Company, d/b/a The Rocky Mountain News. According to the EEOC litigation settlement report, the complaint, which was filed in July 2003, alleged race discrimination in violation of Title VII of the Civil Rights Act of 1964. Specifically, the complaint alleged that workers directed racial epithets to African-American workers daily and the Defendant did not follow the company policy requiring that he report the harassment to Human Resources for Investigation. However, the actual complaint is not available in this case.
The charging party intervened in January 2004. In June 2005 the parties settled and although we do not have a copy of the settlement agreement, the EEOC litigation report stated that Defendant paid a total of $375,000 into a settlement fund, to be distributed among 10 individuals. The only documents we have for this case are the docket and the EEOC's settlement report.
