In September 1998, the Memphis District Office of the EEOC filed this lawsuit against Methodist Healthcare, formerly Methodist Health Systems, in the U.S. District Court for the Western District of Tennessee, alleging discrimination on the basis of race, black, in violation of Title VII of the Civil Rights Act of 1964. We do not have a copy of the complaint; therefore, the exact allegations involved are unknown. However, the Agreement Order indicates that the complaint alleged the defendant refused to promote the complainant, an employee of Methodist Healthcare's Alliance Home Care subsidiary, because of her race, black, due to its classification of employees on the basis of race through a system of coding transfer and promotion requests. Shortly thereafter, the parties settled the lawsuit through an agreement order in January 1999.

The one-year settlement agreement required the defendant to: make compliance reports, provide a neutral reference for the complainant, prohibited the defendant from coding requests for transfers or promotions using race or gender identification and from failing to maintain ordinary business records, post notice of employee rights, and pay $15,000 to the complainant.
