The EEOC's Dallas district office sued Burlington Northern & Santa Fe Railway Company, on May 27, 2004 in the U.S. District Court for the Western District of Oklahoma. The EEOC's complaint alleged that Burlington violated the Americans with Disabilities Act when it discriminated based on disability (physical)by failing to hire a disabled person. Burlington filed a motion for summary judgment on May 2, 2005, which was granted on December 8, 2005. The EEOC appealed on February 13, 2006, but the appellate court affirmed the district court's opinion.
