The EEOC's San Antonio office filed this suit on August 5, 2004, in the Southern District of Texas, Corpus Christi Division. The complaint alleged that defendant Cash & Go, Ltd. violated Title VII and the Equal Pay Act by paying female employees less than male employees for comparable work and for discharging a complainant because of her gender. The defendant filed a motion for summary judgment. On June 28, 2005, the magistrate judge recommended the court deny the motion. Soon thereafter, on July 13, 2005, the parties notified the court of a pending settlement. The court then denied the defendant's motion for summary judgment as moot. The parties filed a proposed consent decree on September 15, 2005. It was entered into the record on October 17, 2005.
The defendant agreed to pay $105,000 to the seven complainants, with specific instructions for apportionment and payment in the consent decree. The defendant also agreed to provide training for "exempt" employees and raise the current pay to three named complainants. The settlement term was 3 years. The docket sheet does not show any further enforcement; the case was presumably closed in 2008.
