The Chicago Office of the EEOC filed this action in the District Court for the Northern District of Illinois. The Defendant was Colonial Ice Cream, Inc., a restaurant and ice cream chain. The controversy involved the alleged sexual harassment of twelve female employees and constructive discharge of one at the defendant's Crystal Lake, IL location. The lawsuit was filed in July 2002 and was resolved by consent decree in October 2003. The parties stipulated to three different protective orders during the litigation. The complainant that alleged constructive discharge, who intervened in the case, was awarded $147,500. The other eleven women were awarded a total of $220,500 with individual awards ranging from $29,500 - $2,000. In addition, the company had to post a notice, distribute it, provide a training session annually which was mandatory for supervisory personnel and optional for other employees, and distribute a new procedure for investigation of sexual harassment complaints. The decree was to last for two years.
