In September 2004, the Phoenix District Office of the EEOC brought this suit against Winslow Memorial Hospital, Inc. in the U.S. District Court for the District of Arizona alleging discrimination on the basis of their race and sex in violation of Title VII of the Civil Rights Act of 1964, and age in violation of the Age Discrimination and Employment Act. We do not have a copy of the complaint; therefore, the exact allegations involved are unknown. However it appears from the Order Granting Defendant's Motion for Summary Judgment that the complaint alleged that the defendant discriminated against the two charging parties on the basis of race, African-American, sex, and age, in failing to consider and subsequently terminating charging parties for the supervisory position of the new department, where charging parties were two department supervisors whose departments were combined with a third and whom did not apply for the position of supervisor of the new department. Following extensive discovery, the defendant filed a motion for summary judgment in November 2005 which was granted in June 2006. The EEOC appealed the decision to the 9th Circuit Court of Appeals in August 2006 (Case #06-16523). The dispute was settled through referral with a Circuit Mediator and dismissed in February 2007.
