In May 1998, the Chicago office of the EEOC brought this suit against Yellow Freight Systems, Inc. in the U.S. District Court for the Northern District of Illinois. The available documents show that the EEOC alleged violation of the Americans with Disabilities Act (ADA) and retaliation. Specifically, the EEOC alleged that Yellow Freight terminated a male employee because of his AIDS-related illness and in retaliation for filing a complaint with the EEOC. In June 1998, the complainant intervened in the suit.
After engaging in discovery, an attempt at settlement was made, but no agreement was reached between the parties.
The defendant eventually filed a motion for summary judgment in April 1999, which was granted in August 1999, and the case was dismissed. The EEOC and intervenor plaintiff filed a notice of appeal the next month. The appeal was heard by the Seventh Circuit, and the decision of the district court was affirmed in August 2001. E.E.O.C. v. Yellow Freight System, Inc., 253 F.3d 943 (7th Cir. 2001).
