Case Summary

The Baltimore Office of the EEOC brought this suit against Mega Contractors, Inc. in the United States District Court for the Eastern District of Virginia in September 1999. According to the unpublished appellate opinion (8 F. App'x 241 (4th Cir. 2001)) the complaint alleged that the Defendant violated Title VII's prohibition of race discrimination. The complainant, an asphalt plant operator, was allegedly terminated and subsequently not rehired because he was African American.

The Defendant's motion for summary judgment was denied. The parties were referred to a settlement conference with a magistrate judge, although the docket does not indicate that this conference took place. A jury trial was held in June 2000, and the Defendant unsuccessfully moved twice for judgment as a matter of law at the close of the EEOC's case. The jury found for the Defendant, who unsuccessfully appealed the district court's decision to deny its motion for attorney's fees.
