In September 2004, the Birmingham District Office of the EEOC filed this lawsuit against Hannon's Food, Inc., doing business as Kentucky Fried Chicken, in the U.S. District Court for the Southern District of Mississippi. We do not have a copy of the EEOC complaint; therefore, the exact allegations are unknown. However, the intervenor's complaint indicates the defendant allegedly discriminated against the four charging parties, female employees, by maintaining a sexually hostile work environment leading to the constructive discharge of complainants, and in one case the retaliatory discharge of a complainant. Following some discovery, the parties settled the lawsuit in April 2006 through a consent decree.

The decree, containing non-discrimination and non-retaliation clauses, required the defendant to: provide complainants with a neutral reference, post and continue to distribute notice of employee rights, provide annual EEO training for managers and supervisors, implement a complaint and dispute resolution process, and pay $15,000 to be distributed among four individuals.
