EEOC's San Antonio, TX office filed this ADEA lawsuit against the defendant H.E.Butt Grocery Company at the United States District Court for the Western District of Texas (San Antonio) on 03/22/2000. EEOC represented those individuals who applied for a store management trainee position from 09/01/1996 to 01/01/1997 but were not hired because of their age. At the time of the lawsuit, EEOC was yet to identify those individuals.
The parties settled the lawsuit before the defendant answered the complaint. A consent decree was entered into judgment on 07/05/2000.
Under the three-year consent decree, the defendant agreed to pay a total of $70,000 to all individuals pro rata to each. The defendant was required to hire a percentage of age-protected individuals commensurate with the percentage of non-age-protected individuals. Additionally, the defendant needed to post an EEO notice and provide annual trainings to HR personnel on age discrimination in hiring and recruiting.
