The St. Louis District Office of the EEOC brought this case in the U.S. District Court for the Eastern District of Missouri, against Fedex Freight East, Inc. The complaint, filed in September 2003, alleged race discrimination in violation of Title VII of the Civil Rights Act of 1964. The St. Louis District Office of the EEOC brought this case in the U.S. District Court for the Eastern District of Missouri, against Fedex Freight East, Inc. The complaint, filed in September 2003, alleged race discrimination in violation of Title VII of the Civil Rights Act of 1964. Specifically, the complaint alleged that Defendant racially harassed the charging parties and discriminated against them because of their race (African American) in terms of hiring, promoting, demoting, firing, and other conditions such as assignment, hours, and training.

The Defendant moved for summary judgment in May 2005, but the motion was never ruled on, and the parties entered into a consent decree in October 2005. The decree was valid for three years and required the defendant to pay a total of $500,000 to the six charging parties. Defendant was enjoined from discriminating in violation of Title VII, required to report regularly to the EEOC about its compliance with the decree, and required to survey its employees every six months to ask if they believed that assignments were being handed out fairly. By agreement, the decree was modified in November 2005 to include two additional claimants.

As there is no additional enforcement activity, the matter presumably ended in October 2008.
