Case Summary

In September 2000, the Dallas District Office of the EEOC filed this lawsuit against BICC General Cable Industries, Inc., General Cable Industries, Inc., and General Cable Corporation, Inc. in the U.S. District Court for the Northern District of Texas alleging discrimination on the basis of race, black, and national origin, African, in violation of Title VII of the Civil Rights Act of 1964. Specifically, the complaint alleged the defendant subjected the complainants to disparate disciplinary procedures and a hostile work environment, and terminated their employment in retaliation to the complainant's opposition to the alleged discrimination. Following a denied summary judgment motion made by the defendant in February 2002, the parties settled the lawsuit in 2002 through a consent decree.

The thirty-week decree, containing agreements not to discriminate or retaliate, required the defendant to: expunge the complainants' employment records and provide them with a neutral job reference, post and distribute notice of employee rights, provide training to managers and employees who make hiring decisions, implement a complaint dispute resolution mechanism, report upon compliance with the consent decree, and pay the complainants $75,000.
