In September 1999, the EEOC's Baltimore office filed this suit in the U.S. District Court for the District of Maryland against Glen W. Smith & Associates, Inc. This summary, unfortunately, was written without the benefit of many of the pleadings. The EEOC moved for, and was granted, a default judgment in April 2000 due to the non-responsive defendant. The case was then referred to a Magistrate Judge for a determination of damages. In August 2000 the EEOC moved for an entry of damages. The Magistrate, in November 2000, created a report and recommendations that were, a month later, adopted by the court. The court had ordered the defendant to pay $140,902.79 to two complainants. Then, in July 2001, the EEOC moved to add a second defendant, the Environmental Preservation Associates, Inc., as successor to the first. That motion was served on EPAI, but received no response and was granted in October 2001. At that time EPAI became liable for Glen W. Smith's judgment. EPAI then tried to alter or amend the default judgment but was unsuccessful. The default judgment was allowed to stand against both defendants and the case was closed in January 2002.
