The EEOC filed this suit on September 29, 2005 in the U.S. District Court for the Southern District of Illinois (Benton). Five complainants intervened in the suit. The EEOC alleged that defendant J.D. Streett & Company Inc d/b/a Harrisburg BP violated Title VII by subjecting complainants to sexual harassment and a hostile work environment. The defendant initially filed a motion to dismiss or in the alternative for a more definite statement, which was denied. Subsequently defendant filed motions to dismiss and for summary judgment against one of the intervenors. The motion for summary judgment was granted on the grounds that the intervenor was not the party in interest due to a bankruptcy proceeding. The remaining parties reached a settlement agreement at a settlement conference held on December 12, 2006. The case was dismissed and the consent decree entered on January 25, 2007.
In the consent decree, the defendant agreed to pay a total of $250,000, divided among the four remaining complainants. Defendant also agreed to post notice, provide training for its employees and report complaints of discrimination to the EEOC during the two-year decree. The docket sheet does not show any further enforcement; the case was presumably closed in 2009.
